Terms and Conditions for EdgeStaker

1. AGREEMENT TO TERMS

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and EdgeStaker (“we,” “us,” or “our”), concerning your access to and use of EdgeStaker.com, our Discord server and any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and you must discontinue use immediately.

2. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, text, graphics, the predictions, models, edges, value scores and stake recommendations generated by our system (collectively, the “Content”) and the trademarks and logos contained therein (the “Marks”) are owned or controlled by us and are protected by copyright and trademark laws. The Content and the Marks are provided on the Site “AS IS” for your personal, non-commercial use only. Except as expressly provided in these Terms and Conditions, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, sold, licensed, scraped, or otherwise exploited for any commercial purpose whatsoever without our express prior written permission.

3. USER REPRESENTATIONS

By using the Site, you represent and warrant that:

  1. All registration information you submit will be true, accurate, current, and complete.
  2. You have the legal capacity and you agree to comply with these Terms and Conditions.
  3. You are at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater.
  4. Sports betting is legal in the jurisdiction from which you access the Site, and you are solely responsible for ensuring your own compliance with all applicable local laws.
  5. You will not use the Site for any illegal or unauthorised purpose.
  6. Your use of the Site will not violate any applicable law or regulation.

4. USER REGISTRATION

You may be required to register with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate or obscene.

5. PURCHASES AND REFUNDS

We offer digital subscription products for purchase on the Site. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. All payments are handled by our third-party payment processors. Subscriptions renew automatically each month at the rate displayed at the time of purchase until cancelled.

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of your current billing period; you retain access to the Service until that period ends.

Refund Policy

ALL SALES ARE FINAL AND NO REFUND WILL BE ISSUED.

Due to the digital, time-sensitive nature of our products (live MLB predictions delivered instantly upon purchase and consumed in real time), we do not offer refunds, prorations, or credits for any purchases, including partial-month cancellations. By completing your purchase, you acknowledge and agree that you are waiving any right to a refund. Please review our public historical results and try the daily free pick before purchasing.

6. PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than that for which we make it available. Prohibited activity includes, but is not limited to:

  • Systematically retrieving data or content from the Site to create or compile, directly or indirectly, a collection, database, or directory without our written permission (i.e., data scraping or automated harvesting).
  • Reselling, redistributing, syndicating, or republishing any predictions, edges, value scores, stake recommendations or other Content from the Site, including in tipping groups, paid or free.
  • Sharing your account credentials with any other person.
  • Using the Site as part of any effort to compete with us or to develop a competing prediction service.
  • Attempting to decipher, decompile, disassemble, or reverse engineer any of the software comprising or making up any part of the Site.
  • Using any information obtained from the Site to harass, abuse, or harm another person, whether on Discord or elsewhere.
  • Disruptive behaviour on our Discord server, including spam, harassment, hate speech or attempts to circumvent moderation.

7. DISCLAIMER OF WARRANTIES

THE SITE AND SERVICE ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF THE SITE’S CONTENT OR PREDICTIONS. THE CONTENT PROVIDED IS FOR INFORMATIONAL AND ENTERTAINMENT PURPOSES ONLY. THE SERVICE IS NOT A GAMBLING SITE, DOES NOT ACCEPT WAGERS, AND DOES NOT FACILITATE BETTING TRANSACTIONS. ALL PREDICTIONS ARE PROBABILISTIC FORECASTS AND ARE NOT GUARANTEED TO BE ACCURATE. PAST PERFORMANCE, INCLUDING ANY HISTORICAL ROI, WIN RATE OR ACCURACY FIGURES PUBLISHED ON THE SITE, IS NOT INDICATIVE OF FUTURE RESULTS. WE ARE NOT A FINANCIAL ADVISOR, AND THE CONTENT SHOULD NOT BE CONSTRUED AS FINANCIAL OR INVESTMENT ADVICE. YOU ARE SOLELY RESPONSIBLE FOR ANY BETTING DECISIONS OR OTHER ACTIONS YOU TAKE BASED ON THE CONTENT, AND FOR ANY RESULTING FINANCIAL GAINS OR LOSSES.

8. LIMITATION OF LIABILITY

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOST BETTING STAKES, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE OR ANY BETS PLACED IN RELIANCE ON THE CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE IS TO STOP USING THE SITE.

9. RESPONSIBLE GAMBLING

Sports betting carries real financial risk and can become addictive. Only ever stake what you can afford to lose. If you feel your gambling is becoming a problem, please seek help from a qualified organisation such as BeGambleAware (www.begambleaware.org) or the National Council on Problem Gambling (www.ncpgambling.org). EdgeStaker does not provide therapy or addiction support and is not a substitute for professional help.

10. TERM AND TERMINATION

These Terms and Conditions shall remain in full force and effect while you use the Site. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS AND CONDITIONS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SITE OR OUR DISCORD SERVER (INCLUDING BLOCKING CERTAIN IP ADDRESSES OR DISCORD ACCOUNTS) TO ANY PERSON FOR ANY REASON, INCLUDING BREACH OF THESE TERMS.

11. GOVERNING LAW

These Terms and Conditions and your use of the Site are governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of the United Kingdom.
